Montana has a medical marijuana program for qualifying patients. Although Montana does not have a specific dispensary program, it allows patients to designate a provider who is subject to possession limits. Providers can provide both flower and infused cannabis products to their patients.
01. What medical conditions will qualify a patient for medical marijuana?
The approved medical conditions for Montana's medical marijuana program include: cancer, glaucoma, HIV/AIDS, cachexia or wasting syndrome, intractable nausea, epilepsy, seizures, multiple sclerosis, Chron's disease, severe muscle spasms, hospice care, and chronic pain.
02. What documentation do I need from the recommending physician to provide with my application?
An original physician's statement signed by a physician must be submitted with the application.
03. Who can write a medical marijuana certification for a patient?
Only a licensed medical doctor or doctor of osteopathy can complete the physician's statement form.
04. How much will it cost to apply for a registry identification card?
Patient application fees are $75.
05. Can minors register in the program?
Yes, minors can register in the program, but a parent or legal guardian must also fill out the minor application form authorizing use and two statements from physicians are required.
06. What is the possession limit?
Registered patients are limited to 12 seedlings, 4 mature plants, and 1 ounce of usable marijuana.
07. Is registration optional or mandatory?
Registration is mandatory in mandatory to benefit from the protections of the law.
08. Does the state honor other states' registries?
No, Montana has no reciprocity agreements with other states.
09. Can I choose any dispensary or do I have to designate a specific one?
Montana does not have a dispensary program. However, providers can be named by a card holder on their application and patients can get marijuana and marijuana infused products from providers.
10. Can a physician revoke a patient's written certification?
Physicians outline the length of marijuana use recommended for the patient, but it cannot be longer than a year. Once the period of recommendation has run out, patients are required to re-apply.
11. How do I renew my card?
The same application form is used to renew cards. The renewal fee is also $75.
12. What happens if I lose my card?
Patients can use the change request form to request a replacement card
13. How does the state law work with federal laws?
It is important to recognize that these state marijuana laws do not change the fact that using marijuana continues to be an offense under Federal law.
14. How can I become a designated caregiver?
Montana has a "provider" program rather than a caregiver program which works similarly. Providers must be designated by a registered patient and a provider must fill out the provider application and submit a $50 fee. Fingerprints and background check processes are also required.

Yes, designated providers can cultivate marijuana but are limited to 12 seedlings, 4 mature plants, and 1 ounce of usable marijuana per registered patient.
